A workbook, not a lecture

Got a TCPA demand letter? Work through it one sheet at a time.

Eight checklists and worksheets for a business that just received a Telephone Consumer Protection Act demand letter. Each one is something you complete: tick the boxes, fill in the dates, run the numbers, print it, hand it to your lawyer. Your answers stay in your browser.

The sheets, in the order you need them

Day one through to the fix list. You do not need to do them all today. Day one and the records sheet matter before the deadline. The rest can wait for your lawyer.

  1. Checklist

    Day one checklist

Twelve things to do on the day a TCPA demand letter arrives, in order, with a checkbox for each. Nothing to buy, nobody to call yet.

  2. Checklist

    Gather your records

Call logs, dialer exports, consent records, vendor contracts and DNC scrubs. Where each one lives and why you need it before you respond.

  3. Worksheet

    Exposure worksheet

Work out what a TCPA claim could cost. Calls times $500 or $1,500, a Florida add-on, and the difference between the letter and the campaign.

  4. Structure

    Response letter structure

The six sections of a written response to a TCPA demand letter, what each one does, and the three things that should never go in one.

  5. Worksheet

    Negotiation prep sheet

A one-page prep sheet before you or your lawyer talk numbers: your exposure, your floor, their floor, and the terms that matter more than the figure.

  6. Worksheet

    Timeline worksheet

Record the dates that decide a TCPA matter: when the calls happened, when the letter arrived, the deadline, and the four-year limitations clock.

  7. Checklist

    Questions for your lawyer

Twenty questions for the first conversation with a lawyer about a TCPA demand letter, grouped by fees, exposure, defences, and what happens next.

  8. Checklist

    Compliance fix list

Fourteen changes to calling, texting, consent and vendor practice that close the gaps a TCPA demand letter exposed. Tick each one off as it is done.

How to use this site

Every sheet has real checkboxes and fields. What you tick or type is stored in your browser with localStorage and never leaves your device. Clear it with the link at the top of each sheet, or by clearing site data in your browser.

Every sheet has a print button. The print layout drops the navigation and keeps the boxes, so a paper copy works as a worksheet too.

The numbers on this site come from the statute and the rules: 47 U.S.C. § 227, 47 C.F.R. § 64.1200, and for Florida recipients Fla. Stat. § 501.059. Statutory damages are $500 per violation and up to $1,500 if a court finds the violation willful or knowing. The federal limitations period is four years. Where a figure depends on your facts, the sheet says so rather than guessing.

One pointer. If your letter came from LAC Litigation & Enforcement Group, its response page is at lacadvocacy.com/received. For a letter from anyone else, the sheets here still apply.
